It also requires the developer to meet acceptable standards of provision determined by Supplementary Planning statements and industry recognised technical standards.
It removes the responsibility for the management and maintenance of recreational land from the Local Authority to FIT, ensuring Section 106 compliance and guaranteeing public access.
Section 106 Agreements
A Section 106 Agreement is another name for a planning obligation. It is a private agreement negotiated usually in the context of planning applications, between an applicant and the local planning authority. In the context of FIT's work, it is a means of securing contribution in kind or financially for open space facilities. It can include a contribution to capital and maintenance requirements.
